1. What is a Sensitive Land Certificate?

A sensitive land certificate identifies the features and legal sensitivities of a property under New Zealand’s Overseas Investment Act 2005 (the Act). It confirms whether the land is considered 'sensitive land' and the reasons why.

 

2. Who needs a Sensitive Land Certificate?

Overseas persons—including non‑residents, foreign‑owned companies, and trusts—require a certificate when acquiring sensitive land.

 

3. What types of land are considered ‘sensitive’?

All land in New Zealand that appears on the District Valuation Roll with a property category of 'residential' or 'lifestyle' is  'residential land', and is considered sensitive land under the Act.

Land can also fall into the sensitive category for other reasons—these may relate to its overall size, its specific land type, or the features or areas it borders. When a property is classed as sensitive for reasons other than its residential/lifestyle category on the District Valuation Roll, it is referred to as “otherwise sensitive” land, and additional or different rules may apply.

Land can have more than one sensitivity. For example, it can be residential and otherwise sensitive land.

 

4. Why is a Sensitive Land Certificate required?

An accurate sensitive land certificate will allow you to determine whether or not land is sensitive, and why. You must provide a sensitive land certificate with any application to Toitū Te Whenua Land Information New Zealand (LINZ) for consent to buy sensitive land. 

 

5. Who is qualified to issue a Sensitive Land Certificate?

LINZ state that sensitive land certificates can only be prepared by professionals with the appropriate specialist expertise. This includes:

  • Lawyers who work with LINZ and the Overseas Investment Office on a regular basis, and
  • LINZ Accredited Suppliers who are experienced in producing sensitive land certificates — a group that APL Property is part of.
